Terms of Service
Last updated Oct 22, 2026
Plain-English terms for booking photography, video, drone and 3D work with Estate Shutter. The short version: $0 until you approve, free reshoots of anything that isn’t right, free weather reschedules, and photos 12–24 hours after the shoot. Questions? See the FAQ or call (226) 271-2773.
1. These terms
These terms apply whenever you book a service with Estate Shutter (“we”, “us”), whether you book online, by phone, by text or by email. By booking, you (“you”, “the client”) agree to them. A booking confirmed by phone is as binding as one made online.
Commercial programs and home-service content plans have extra terms in sections 13 and 14. Where a written quote from us sets different terms for a job, the quote applies to that job.
2. Booking and confirmation
When you book, we confirm the address, the date and time, the services booked and the price by email. Services and prices are those shown when you book; add-ons are confirmed with you before they are added.
Changes to your order go through us (call, text or email) so they are priced and confirmed in writing. On the day, tell your photographer about access, rooms to skip and anything that must not be photographed.
3. Payment
$0 until you approve. Nothing is charged when you book: no deposit and no account. We deliver your gallery for review, and you pay once you approve it.
Payment is due within 48 hours of your approval. Downloading for publication, publishing or sharing any delivered file counts as approval. Unless you have an approved account (section 12), please pay before you publish the files.
Credit card, debit or e-transfer. Prices are in Canadian dollars; HST is added at checkout. An invoice still unpaid 7 days after it is due may attract a late fee.
4. Delivery
Delivery times run from the end of the shoot, not from the booking. Our delivery times are:
- Photos (every package): 12–24 hours after the shoot.
- Drone photos: with the photo set.
- Floor plans: 24–48 hours after the shoot.
- 3D virtual tour: 24–48 hours after the scan.
- Video: 48–72 hours after the shoot.
- Digital staging: 48–72 hours after the shoot.
Premiere: priority editing, first in the queue. Need it sooner? Rush delivery (same-day or next-morning photos) is +$75: pick it when you book and it is added to your invoice. At very busy times delivery can occasionally take longer; if it will, we tell you.
Files are delivered through an online gallery. Please download and keep your files within 30 days of delivery; after that, restoring them may carry a re-hosting fee, and we can’t guarantee they are still available.
5. Reshoots and revisions
Free reshoot. If a shot isn’t right, we come back and reshoot it at no charge. A shot isn’t right when the problem is something we control: a room, view or shot on your order that we missed; exposure, focus, colour or straight-line problems; editing mistakes. Tell us before you approve the gallery.
A reshoot is quoted before it is booked when the property was not ready or accessible at the booked time; or staging, furniture or the property changed after the shoot; or you would like a different look after approving the gallery.
Creative choices such as angles and composition are ours to make. If you need particular shots, put them on your order or tell us before the shoot.
Digital staging includes one free revision per room, requested within 48 hours of delivery.
6. Weather
If rain, snow, wind or poor light would spoil the exterior or make a flight unsafe, we photograph the interior as planned and come back for the exterior and drone work at no charge. Light rain or overcast skies alone usually do not stop a shoot.
Whether a flight is safe and legal is always the pilot’s call, under Transport Canada rules.
7. Cancelling, rescheduling and no-shows
Free to cancel or reschedule with 24 hours’ notice; under 24 hours, up to 50% of the booked services. Weather reschedules are always free.
If nobody can give us access within 15 minutes of the start time and we can’t reach you, the visit counts as a no-show and is charged in full.
If we arrive and can’t complete the shoot because the property is not accessible or not ready, the visit is charged in full and a return visit is booked as a new shoot.
Reply to your confirmation email, call or text us. You can reach us at (226) 271-2773 or info@estateshutter.ca.
8. 30-day relaunch guarantee
Book a Listing Launch or Premiere shoot. If the listing is still on the market 30 days after we deliver your photos, we come back once, free, with fresh exteriors and a 30-second reel. Request it by call or text.
Conditions: Listing Launch or Premiere packages booked from Oct 19, 2026. Listing still active (not sold firm) 30+ days after photo delivery; request the relaunch within 60 days of delivery. Same property and agent, inside our service area, property show-ready. One relaunch visit per listing (fresh exteriors + one 30-second reel; interiors not included).
9. At the property
You are responsible for the property being safe, accessible and ready at the booked time. We send a preparation checklist when you book; a reshoot needed because the property was not ready is quoted (section 5).
If the shoot runs more than 15 minutes past its scheduled time because of delays on your side (the property not ready, a late arrival, or interruptions on site), we may charge for the extra time.
Please don’t make side payments or side agreements with photographers; everything goes through us.
10. Drone flights
Every flight follows Transport Canada’s drone rules. Founder Mike Brun holds a Transport Canada Advanced drone pilot certificate; every flight is flown by an Advanced-certified pilot. The pilot decides whether a flight can go ahead safely and legally. When a property is in controlled airspace, the flight needs NAV CANADA authorization, and its timing depends on that approval.
If drone work can’t go ahead for safety, legal or airspace reasons, we reschedule it. You are never charged for drone work we did not deliver.
11. Copyright and how you may use the files
Listing photos and media (residential). Estate Shutter keeps the copyright; you get a licence to use the files for that listing. Use the photos to market the listing you booked them for. That includes:
- MLS and real estate portals
- your website, your brokerage’s website and listing sites
- social media and email
- print for that listing: feature sheets, brochures, signs and ads
Other uses, such as another agent relisting the property, a seller’s or builder’s own advertising, or your personal branding, need our written OK first.
Commercial programs. You own every file. Commercial programs (progress, leasing, development launch and architectural): you get full-resolution files after every visit and the complete archive at closeout, with no export fees or lock-in. Ownership of the delivered files passes to you when the invoice for them is paid.
Home-service content plans. You own every file. Ownership of every photo and video passes to you when the invoice is paid; use them on your website, social, ads, trucks and print.
Drone-only and other quoted work. The licence is written on your quote.
Our portfolio. We may show work in our portfolio and advertising. If you’d rather we didn’t, tell us in writing before the shoot.
MLS and staging. Files are delivered MLS-ready and sized for listing sites. Virtually staged photos come with the original empty-room photo. Label staged photos “virtually staged” wherever your board’s rules require it.
12. Accounts and multiple shoots
Agents, teams, brokerages and commercial clients with an approved account can pay on net-15 or net-30 terms.
Each shoot is its own booking: a missed or cancelled appointment does not carry over to another property.
13. Commercial programs
- Fixed quote within 1 business day.
- Progress visits: if the dated report and files are not delivered within 48 hours of a visit, that visit is free.
- Progress visits: any view that is missing or doesn’t match the last visit is reshot at no charge.
- Progress programs: cancel with 30 days’ notice after your first three visits.
- Leasing, development launch and architectural shoots: photos within 48 hours; edited films on the date written in your quote.
- Ownership of the files: see section 11.
14. Home-service content plans
- Content plans start with 3 months, then continue month to month. Cancel with 30 days’ notice.
- Introductory offers apply only while they are shown on our site, to new retainer clients.
- Edited photos and reels within 48 hours of every shoot, or that shoot is free.
- Weather, a no-show job or a shot you don’t love: we come back and reshoot it at no charge. For content plans, this reshoot rule replaces section 5.
- You own every file. Ownership of every photo and video passes to you when the invoice is paid; use them on your website, social, ads, trucks and print.
15. Liability
We are not liable for accidents or damage caused by unsafe conditions at the property, or for marketing delays caused by issues on the client’s side.
You agree to cover us against claims arising from on-site incidents you are responsible for, from third-party disputes about the property, and from use of the files outside your licence.
Our total liability for any service is limited to the amount you paid for it.
16. If something goes wrong
Tell us first: most problems are fixed with a reshoot. Please contact us before starting a chargeback; a chargeback raised without contacting us first is a breach of these terms, and we may recover our costs and decline future bookings.
Concerns about creative choices are handled through the reshoot policy (section 5), not by withholding payment for files you have approved or used. We may recover unpaid balances through collections or the courts, with reasonable collection costs and interest where the law allows.
17. Conduct
We may cancel or refuse service if anyone harasses, abuses, threatens or discriminates against our photographers or staff.
18. Governing law
These terms are governed by the laws of the province where the service is delivered (Ontario, for all of Southwestern Ontario and the Greater Toronto Area) and the federal laws of Canada that apply there. Disputes are handled by the courts or mediation services of that province.
19. Changes to these terms
We may update these terms from time to time. The version on this page when you book applies to that booking.
