Terms of Service

By booking a service with ESTATE SHUTTER FL LLC ("we," "us," or "our"), you ("Client" or "Customer") agree to the following terms and conditions:

1. Booking & Confirmation

Appointments may be scheduled through our official website, by phone, or confirmed in writing (email or text). By booking—regardless of the method—you agree to be bound by these Terms of Service in full. Verbal confirmations by phone are considered legally binding agreements to these terms.

2. Rescheduling & Cancellation Policy

Rescheduling or cancellation with less than 24 hours' notice will incur a $75 USD fee, charged to the payment method on file or added to your invoice. This applies regardless of the reason, including inclement weather (unless deemed unsafe by us), unprepared properties, or last-minute conflicts. If our team arrives and cannot complete the shoot due to inaccessibility or an unprepared property, the full fee will be charged with no refund. If a return visit is required, the Client will be charged the full service rate again for the second visit.

3. No-Show Policy

If no authorized person is present within 15 minutes of the scheduled shoot and we are unable to contact the Client, it is considered a no-show. No-shows are charged in full. The amount will be charged to the payment method on file or added to your invoice. ESTATE SHUTTER FL LLC retains full rights to pursue recovery of unpaid no-show fees through any legal means, including small claims court, third-party collections, or legal enforcement.

4. Payment Terms & Card Authorization

Full payment is due within 48 hours of content delivery, regardless of satisfaction. Use or sharing of any delivered content constitutes acceptance and triggers full payment. No media may be published or distributed prior to payment. Unpaid invoices are subject to late fees after 7 calendar days. The Client authorizes ESTATE SHUTTER FL LLC to charge the stored payment method for:

  • No-shows
  • Late rescheduling/cancellation
  • Late payments
  • Scope changes
  • Dispute resolution or administrative costs

5. Delivery, Revisions & Refunds

Media is typically delivered within 12–24 hours, but may take up to 7 calendar days. No compensation or complaints will be accepted until after this 7-day period. Revisions are limited to scope and do not include preference-based changes. Satisfaction is not a basis for non-payment. All creative decisions—including angles, lighting, and composition—are final. Once services are delivered, no refunds, discounts, or chargebacks will be permitted.

6. Reshoots

Reshoots are not included unless caused by a verified technical error. Changes due to weather, angles, staging, or creative preference are chargeable and scheduled at our discretion.

7. Extra Time On-Site & Delay Fees

Clients are expected to ensure the property is 100% ready and accessible at the time of the appointment. If the photoshoot is extended beyond the scheduled time due to delays caused by the Client, the Client's representative, or the condition of the property—including, but not limited to:

  • property not being prepared or staged,
  • the agent or client arriving late,
  • lengthy explanations or directions to the photographer,
  • or other forms of on-site interference—

ESTATE SHUTTER reserves the right to apply an additional fee for extra time on site. This fee is calculated at our discretion and based on the time impact to our team and other scheduled appointments.

Additional time beyond 15 minutes of the scheduled session may automatically trigger such a charge.

8. Copyright & Usage Rights

All media remains the property of ESTATE SHUTTER FL LLC. Clients are granted a limited, non-transferable license for marketing the booked property only. All other usage requires written permission and may incur licensing fees.

9. Property Condition & Liability

Clients are responsible for property readiness. We are not liable for unsafe conditions, delays, or obstacles caused by property access issues.

10. Weather & Environmental Conditions

Shoots proceed in most weather conditions. Unsafe weather is evaluated at our discretion.

11. Scope of Services

Quoted services reflect the scope agreed at booking. Add-ons must be confirmed in advance.

12. Indemnity & Limitations of Liability

The Client indemnifies ESTATE SHUTTER FL LLC against all liabilities related to property access, third-party disputes, and media use. Total liability is capped at the service amount paid.

13. Chargebacks & Disputes

Clients must attempt to resolve concerns with us before filing any chargebacks. Unjustified chargebacks will be treated as contract breaches. Legal recovery of costs and termination of future services may follow.

14. Turnaround Rush Fees

Rush delivery may be available for an additional non-refundable fee. Turnaround is not guaranteed during unforeseen delays.

15. Client Conduct

Any client engaging in abusive, discriminatory, or inappropriate conduct will be refused service. No refunds will be issued in such cases, and legal action may be taken where necessary.

16. Portfolio Rights

We reserve the right to use delivered content for our portfolio and marketing. Clients may request to opt out in writing prior to the shoot.

17. Digital Delivery Platform Limitations

Media is delivered via Aryeo or Google Drive. Clients must download all files within 30 days. Rehosting may incur a fee.

18. Client Preparedness Checklist Requirement

Clients will receive a checklist prior to their shoot. Failure to comply may impact results and does not qualify for a refund or reshoot.

19. Communication Protocol

All service communication must go through ESTATE SHUTTER FL LLC executives. Clients may not give directions or make payments directly to photographers. Doing so constitutes breach of contract.

20. Multiple Shoots / Batch Projects

Each shoot is governed individually. Missed appointments are not credited. Custom package pricing applies only to pre-booked services.

21. Legal Enforcement & Collection Rights

Subjective dissatisfaction with media quality, angle selection, or lighting does not exempt the Client from payment. ESTATE SHUTTER FL LLC retains full legal rights to pursue collections, small claims, or civil recovery including fees, costs, and administrative charges.

22. Jurisdiction & Governing Law

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law. All disputes will be handled in the appropriate courts of Florida.

23. Agreement & Consent

By booking, the Client confirms that they have read, understood, and accepted these Terms of Service, including payment, legal, and usage policies.

These Terms are subject to change. The most current version will always be available upon request or through our official channels.
