Terms of Service – ESTATE SHUTTER

By booking a service with ESTATE SHUTTER ("we," "us," or "our"), you ("Client" or "Customer") agree to the following terms and conditions:

1. Booking & Confirmation

Appointments may be scheduled through our official website, by phone, or confirmed in writing (email or text). By booking—regardless of the method—you agree to be bound by these Terms of Service in full. Verbal confirmations by phone are considered legally binding agreements to these terms.

2. Rescheduling & Cancellation Policy

We understand that circumstances may change. However, short-notice changes disrupt our operations and availability for other clients.

Rescheduling or cancellation with less than 24 hours' notice will incur a $75 CAD fee, charged to the payment method on file or added to your invoice.

This applies regardless of the reason, including inclement weather (unless deemed unsafe by us), unprepared properties, or last-minute conflicts.

If our team arrives and cannot complete the shoot due to inaccessibility or an unprepared property, the full fee will be charged with no refund. If a return visit is required, the Client will be charged the full service rate again for the second visit.

3. No-Show Policy

If no authorized person is present within 15 minutes of the scheduled shoot and we are unable to contact the Client, it is considered a no-show.

No-shows are charged in full.

The amount will be charged to the payment method on file or added to your invoice.

ESTATE SHUTTER retains full rights to pursue recovery of unpaid no-show fees through any legal means, including small claims court, third-party collections, or legal enforcement.

4. Payment Terms & Card Authorization

Full payment is due within 48 hours of content delivery, regardless of satisfaction.

If deliverables are missing or delayed, full payment is still required. ESTATE SHUTTER reserves the right to decide whether a discount or reshoot is warranted.

Use or sharing of any delivered content (with clients, brokerages, family, etc.) constitutes acceptance and triggers full payment.

No media may be published or distributed prior to payment.

Unpaid invoices are subject to late fees after 7 calendar days.

The Client authorizes ESTATE SHUTTER to charge the stored payment method for:

  • No-shows
  • Late rescheduling/cancellation
  • Late payments
  • Scope changes
  • Dispute resolution or administrative costs

5. Delivery, Revisions & Refunds

Media is typically delivered within 12–24 hours, but delivery may take up to 7 calendar days in cases of high volume or unexpected delays.

No compensation, complaint, or refund request will be accepted until after this 7-day period has passed.

Revisions are available only for items within the original scope of work.

Satisfaction is not a condition for payment.

All work is performed by experienced professionals, and all creative decisions—including but not limited to angles, framing, and composition—are final.

Complaints made after full delivery do not qualify for refunds, discounts, chargebacks, or non-payment.

Once services are delivered or initiated, no refunds will be issued.

All deposits paid to reserve a photoshoot are non-refundable. Deposits secure the photographer's time and date and cannot be transferred or refunded under any circumstances.

Refunds may only be granted if Estate Shutter cancels the photoshoot at its discretion or is unable to complete the service.

6. Reshoots

Reshoots are at the sole discretion of ESTATE SHUTTER.

If caused by weather, staging issues, angle preferences, or similar variables, reshoots will only be offered at an additional cost.

All reshoots must be requested with legitimate, verifiable justification and are priced by us.

7. Extra Time On-Site & Delay Fees

Clients are expected to ensure the property is 100% ready and accessible at the time of the appointment. If the photoshoot is extended beyond the scheduled time due to delays caused by the Client, the Client's representative, or the condition of the property—including, but not limited to:

  • property not being prepared or staged,
  • the agent or client arriving late,
  • lengthy explanations or directions to the photographer,
  • or other forms of on-site interference—

ESTATE SHUTTER reserves the right to apply an additional fee for extra time on site. This fee is calculated at our discretion and based on the time impact to our team and other scheduled appointments.

Additional time beyond 15 minutes of the scheduled session may automatically trigger such a charge.

8. Copyright & Usage Rights

ESTATE SHUTTER retains full copyright of all media.

The Client is granted a limited, non-transferable license to use content for marketing the specific booked property only.

Additional usage (branding, reuse, syndication) requires separate written permission and licensing.

9. Property Condition & Liability

The Client is responsible for the property being clean, safe, and accessible.

ESTATE SHUTTER is not liable for on-site accidents, unsafe conditions, or marketing delays from client-side issues.

10. Weather & Environmental Conditions

Shoots proceed under most weather conditions (e.g., overcast, light rain).

Unsafe weather is evaluated by us, and reschedules are at our discretion.

11. Scope of Services

Services and pricing are defined at booking.

Add-ons (e.g., drone, video, floor plans) must be pre-approved.

Undisclosed requests may lead to partial delivery or extra charges.

12. Indemnity & Limitations of Liability

The Client indemnifies ESTATE SHUTTER from all claims tied to:

  • On-site incidents
  • Third-party disputes
  • Client misuse of content

Total liability is capped at the amount paid for the service.

13. Chargebacks & Disputes

The Client must contact ESTATE SHUTTER to resolve any issue before initiating a chargeback.

Unauthorized chargebacks will be treated as breach of contract.

We may recover costs and suspend future services if a dispute is raised without prior good-faith contact.

14. Turnaround Rush Fees

Rush delivery (faster than 12–24 hours) is available for an additional fee.

Must be requested in advance.

No refunds on rush fees, even if unforeseen delays occur.

15. Client Conduct

ESTATE SHUTTER reserves the right to cancel or refuse service to any client who engages in harassment, verbal abuse, discrimination, or any behavior deemed unprofessional, threatening, or disruptive to our staff or contractors.

Any attempts to intimidate, undermine, or interfere with the work of our photographers or administrative staff may result in immediate termination of the relationship. No refunds or compensation will be issued in such cases. ESTATE SHUTTER may also pursue legal remedies if necessary.

16. Portfolio Rights

ESTATE SHUTTER may use any shoot content in its portfolio or advertising.

Clients may request opt-out in writing before the shoot.

Requests made after delivery may not be honored.

17. Digital Delivery Platform Limitations

All files will be delivered through Aryeo or Google Drive.

Clients must download and store their media within 30 days.

Retrieval after this period may incur rehosting or admin fees.

We are not responsible for file loss after this window.

18. Client Preparedness Checklist Requirement

Clients will receive a checklist before the shoot.

If the checklist is not followed, ESTATE SHUTTER is not responsible for the resulting outcome.

No refunds, discounts, or reshoots will be provided in these cases.

19. Communication Protocol

All communications must go through ESTATE SHUTTER executives (email, phone, or contact form).

Clients must not give direction, complaints, or feedback directly to photographers.

No direct payment, tips, or side agreements with photographers are allowed—doing so is a breach of contract.

20. Multiple Shoots / Batch Projects

Each shoot under a multi-property package is treated as an individual agreement.

A missed or canceled appointment does not carry over.

Package discounts apply only to services booked together in advance.

Missed shoots are considered fulfilled unless rescheduled under standard policy.

21. Legal Enforcement & Collection Rights

ESTATE SHUTTER retains the absolute right to pursue legal action, collections, and enforcement at any time for unpaid fees or breach of these Terms. This includes but is not limited to small claims court, civil litigation, third-party debt collection, and other legal remedies.

Client dissatisfaction with subjective elements of the deliverables—such as angles, lighting, image style, or creative decisions—does not exempt the Client from payment. All services are rendered professionally by experienced personnel, and creative discretion lies solely with ESTATE SHUTTER.

By agreeing to these Terms, the Client waives any right to withhold payment based on subjective dissatisfaction or perceived quality issues. In such cases, ESTATE SHUTTER reserves the right to recover all unpaid balances through any lawful means, including recovery of legal fees, filing fees, interest, and administrative expenses incurred in the collection process.

22. Jurisdiction & Governing Law

These Terms are governed by the provincial and federal laws of Canada where the service is delivered. All disputes will be handled in the courts or mediation centers of that province.

23. Agreement & Consent

By booking, the Client confirms they have read, understood, and agreed to these Terms, including payment authorization, communication protocols, and use policies.
